This can be a very sensitive area and we pride ourselves in bearing in mind how difficult it can be for people to cope with the implications of a marriage or relationship break-up and the complicated issues which can arise. 

We feel that negotiation and discussion is a central part of the separation/divorce process and should be availed of wherever possible in preference to litigation.  We will advise you to consider counseling or mediation as an alternative to litigation. 

In the context of a relationship breakdown, a host of very difficult issues can arise including who shall have the day to day care and control of any dependent children.  The family home and property may need to be sold or transferred from one party to the other.  Pension rights may need to be adjusted and indeed protection may need to be arranged where violence forms part of the difficulty. 

There can be complex tax issues and financial arrangements to be made and we advise and act on all areas of family law. 

For many people who are already separated, often for a long number of years, the question of a divorce, entitling people to remarry may arise and you may be entitled to a divorce if:

 
  • You have lived apart from your husband or wife for 4 of the previous 5 years and there is no reasonable prospect of reconciliation and where proper provision will be made for your spouse and any dependent children.
 
It is important in a family law matter to bring any relevant information to your first consultation and this can include your marriage certificate, any previous court orders or a deed of separation.  It is also important to be in a position to provide a financial profile both in respect of yourself and your husband or wife or partner relating to employment, properties and earnings etc.
